Privacy Notice
This Privacy Notice (“Notice”) applies to personal information Trividia Health, Inc. (collectively, “Trividia Health” “we,” “us,” or “our”) collects. This Notice also covers rights and choices related to your personal information
Active Information Collection
We actively collect information from you both by asking you specific questions and by permitting you to communicate directly with us via email, feedback forms, and/or chat rooms. Some of the information that you submit may be personal information (that is, information that can be uniquely identified with you, such as your full name, address, email address, phone number, and so on). We may also ask you to submit information in order for you to benefit from the specified features (such as newsletter subscriptions, tips/pointers, order processing) or to participate in a particular activity (such as sweepstakes or other promotions).
Passive Information Collection
As you navigate through our website or content, certain information can be passively collected (that is, gathered without your actively providing the information) using various technologies and means, such as Internet Protocol addresses, cookies, Internet tags, and navigational data collection. We collect Internet Protocol (IP) addresses. An IP Address is a number assigned to your computer by your Internet service provider, so you can access the internet and is generally considered to be non-personal information, because in most cases an IP address is dynamic (changing each time you connect to the Internet), rather than static (unique to a particular user’s computer). We use your IP address to diagnose problems with our server, report aggregate information, determine the fastest route for your computer to use in connecting to our website or content, and administer and improve the website or content.
A cookie is a bit of information that a website sends to your web browser that helps the site remember information about you and your preferences.
Internet tags (also known as single-pixel GIFs, clear GIFs, invisible GIFs, and 1-by-1 GIFs) are smaller than cookies and tell the website server information such as the IP address and browser type related to the visitor’s computer. We do not use Internet tags.
Navigational data (“log files,” “server logs,” and “clickstream” data) are used for system management, to improve our content, market research purposes, and to communicate information to visitors. We use navigational data.
Online Tracking
We use “cookies” to track your access across third-party websites to provide you with targeted advertising for our products that you may be interested in. If you receive targeted advertising from us, you will be provided with the ability to opt-out from future communications. We will not disclose any online tracking information outside of Trividia Health or Trividia Health Affiliates unless otherwise specified in this Privacy Notice. We will not sell information obtained from any online tracking to any third-party. You can block our tracking by ensuring that your internet browser is set to “Do Not Track”. Trividia Health will honor any “Do Not Track” signal received from your browser.
HIPAA
Trividia Health is not a “covered entity” under the HIPAA privacy and security rules, however, in some instances we may be considered a “business associate” under the HIPAA privacy and security rules. Where we act as a business associate, please review the privacy policies of your healthcare provider or other covered entity to whom you have provided your protected health information, as that term is defined under HIPAA.
Data We Collect
As outlined above, we collect data about you in different ways. For example, we collect data:
- Directly from you. This includes when you sign up to get our emails or contact us.
- This includes through cookies, server logs, and other tools on our website or apps.
- From other sources. These can include our affiliates, vendors, social media, publicly available sources, and other companies.
We keep your personal information for only as long as necessary to fulfil the purposes in this Notice unless a longer retention period is required or permitted by law. This includes the purposes of satisfying legal, accounting, or reporting requirements. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the data. We also weigh the potential risk of harm from unauthorized use or disclosure of the data, the purposes for which we obtained the data and whether we can meet those purposes through other means, as well as applicable legal requirements.

Use and Disclosure of Information

We may disclose your personal information to other Trividia Health affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control) that agree to treat it in accordance with this Privacy Notice. In addition, we may disclose your personal information to third parties, located in the United States, but only:
(i) in connection with any acquisition or negotiations to acquire all or a portion of Trividia Health, our business, or our assets;
(ii) to contractors we use to support our business (e.g., fulfillment services, technical support, delivery services, and financial institutions), in which case we will require such third parties to agree to treat it in accordance with this Privacy Notice;
(iii) in connection with the sale, assignment, or other transfer of our business to which the information relates, in which case we will require any such buyer to agree to treat it in accordance with this Privacy Notice; or
(iv) where required by applicable laws, court orders, or government regulations. In addition, we will make full use of all collected information that is not in personally identifiable form.

Your Choices
Depending on where you live, you may have certain rights over the information that we collect from you. These rights may include:
- Access. You may request access to your personal information or confirmation that we have data about you by contacting us at the address below. In certain limited cases, you may ask to receive access to your data in a portable, machine-readable form.
- Change. To keep your personal information accurate, current, and complete, you can ask us to correct inaccurate or incomplete data by contacting us at the address below. We may keep historical data in our backup files as permitted by law. We will take reasonable steps to update or correct personal information in our possession that you have previously submitted.
- Deletion. You may ask us to delete your personal information. If required by law, we will grant such a request, but note that in many cases, we must keep your personal information to comply with legal obligations, resolve disputes, enforce agreements, or for other business purposes.
- Opt-out of Targeted Advertising. You may opt-out of online tracking based targeted advertising (e.g., cookies) by clicking the Cookie Settings. Note that if you change browsers or devices, or if you clear your browser’s cache, you may need to click the link again to apply your preference. We recognize Global Privacy Control (GPC) signals broadcast from web browsers as a valid opt-out request where required by applicable law. Please note that the GPC will apply only to your current browser. As stated above, Trividia Health will honor any “Do Not Track” signal received from your browser. If there is a conflict between the GPC signal and a manual choice that you have made on our website regarding targeted advertising, we will honor your manual choice.
- Promotional Emails. You may provide us with your email address to allow us to send newsletters, surveys, offers, or other promotional content, as well as targeted offers from third parties. You can stop receiving such emails by following the unsubscribe instructions at the bottom of those emails. If you choose not to receive such emails, we may still send you service-related communications.
- Promotional Mailings. If you do not want to receive offers and/or circulars from us, email us with “NO SNAIL MAIL” in the subject line, and include your name, address, and zip code. Note that our mailings are prepared before we send them. We will remove your name from our mailing list after receiving your request, but you may receive mailings from us that were prepared prior to processing your request.
Not all the rights above are absolute, and they do not apply in all circumstances. We may limit or deny a request because the law permits or requires us to. We will not discriminate against individuals who exercise their privacy rights under applicable law.
You may exercise the above rights through contacting us via the contact information below. If you disagree with our denial of a request, you may appeal our decision by contacting us with the subject line “Appeal” or through our Customer Care Form.
As required by law, we will require you to prove your identity. We may verify your identity by phone call or email. Depending on your request, we will ask for information such as your name, email address, phone number, mailing address, or applicable Trividia Health product. Following a request, we will use reasonable efforts to supply, correct or delete personal data about you in our files.
In some circumstances, you may designate an authorized agent to exercise privacy rights on your behalf. If you are an authorized agent submitting a request on behalf of an individual, you must attach a copy of signed and notarized permission from the individual stating that you, as the agent, have authorization to act on such individual’s behalf.
Additional Information For California Residents
California law requires us to disclose the following information on our privacy practices. If you are a California resident, the following disclosures apply to you in addition to the rest of the Notice.
- California Shine the Light. California law permits California residents to request information regarding our disclosure of your information to third parties (if any), including the categories of information shared and a list of the names and addresses of third parties with whom the information was shared. If you are a California resident and would like a copy of this Notice, please send an email request and identify that it is a “Shine the Light Request” in the subject line of the email, or send a letter or message using the information in the “How to Contact Us” section.
- California Sensitive Information Disclosure. We do not collect sensitive personal information (as defined under California law) or use such data for any purposes that are not identified within the California Privacy Rights Act Section 1798.121. We do not “sell” or “share” sensitive personal information for cross-context behavioral advertising, although we may transfer it to third parties when you instruct us to do so. When that occurs, third parties will use it for the purposes indicated in their privacy notices.
Security
We have implemented reasonable security safeguards to protect your personal information and to protect such information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. You should keep in mind that no internet transmission or electronic storage is ever 100% secure or error-free.
